RPlan Terms of Service

Welcome to RPlan ("RPlan," "we," "us," or "our"), a free trip planning web application available at rplan.org. These Terms of Service ("Terms") govern your access to and use of RPlan (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. The Service

RPlan is a free-of-charge trip planning tool. It may allow you to build itineraries, search for locations, and view maps and related information, in part through integration with Google Maps Platform and other third-party services.

RPlan is provided free of charge, and there is no subscription, purchase, or payment required to use the core Service as currently offered.

2. "Best Effort" Basis: No Uptime or Availability Guarantee

2.1 Best Effort. RPlan is operated on a best-effort basis. We aim to keep the Service available and running smoothly, but we are under no obligation to do so and make no guarantee, warranty, or commitment regarding uptime, availability, performance, or continuity of the Service.

2.2 No SLA. There is no service-level agreement (SLA) associated with RPlan. The Service may be slow, unavailable, interrupted, degraded, or discontinued at any time, with or without notice, for any reason, including maintenance, technical failure, third-party outages (including Google Maps Platform outages), cost constraints, or discontinuation of the project entirely.

2.3 No Support Obligation. We are not obligated to provide technical support, bug fixes, updates, or maintenance of any kind, though we may do so at our discretion.

2.4 Discontinuation. We reserve the right to modify, suspend, or permanently discontinue the Service, in whole or in part, at any time without liability to you.

3. Eligibility and Accounts

3.1 Age Requirement. You must be at least 15 years old (the minimum age of digital consent under French and EU law) to use RPlan. If you are under 18, you should have a parent or guardian's permission to use the Service.

3.2 Accounts. RPlan allows you to create an account using your name, email address, and a password in order to save and access your trip data. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us at contact@rplan.org if you suspect unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Attempt to gain unauthorized access to the Service, its infrastructure, or other users' data;
  • Interfere with, disrupt, or place undue burden on the Service or its underlying infrastructure (including excessive automated requests or scraping);
  • Reverse engineer, decompile, or attempt to extract source code from the Service, except where permitted by law;
  • Use the Service in a manner that violates Google's Terms of Service or Google Maps Platform Terms of Service (see Section 6);
  • Misrepresent your identity or impersonate any person or entity;
  • Upload or transmit malicious code, viruses, or harmful content.

We reserve the right to suspend or terminate access for any user who violates these Terms.

5. User Content

5.1 Your Data. The Service allows you to input trip details, itineraries, notes, and other content ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant RPlan a limited, non-exclusive, worldwide, royalty-free license to store, process, and display that content solely for the purpose of operating and providing the Service to you.

5.2 No Guarantee of Data Retention. Because the Service is offered on a best-effort basis (see Section 2), we do not guarantee that User Content or saved trip data will be preserved, backed up, or recoverable. Data may be lost due to technical failure, service changes, discontinuation, or other causes. You are solely responsible for maintaining your own copies of important trip information.

5.3 Responsibility for Content. You are solely responsible for the accuracy and legality of any content you submit.

6. Third-Party Services

6.1 Mapping (OpenStreetMap via MapTiler). Maps displayed within RPlan are rendered client-side using the open-source Leaflet library, using map tiles provided by MapTiler, built on OpenStreetMap data made available under the Open Database License (ODbL). Attribution (© MapTiler, © OpenStreetMap contributors) is displayed directly on the map, alongside credit to the Leaflet library.

6.2 Google Maps Services. RPlan uses Google's Geocoding/Places API, via RPlan's own server and API key, to resolve place names you search for within the app into locations. Only the search text you enter is sent for this purpose; your personal identifiers are not included in this request. This is subject to the Google Maps Platform Terms of Service.

RPlan also provides links that take you directly to Google Maps for directions or additional context. These are ordinary hyperlinks to Google's own website; once you click through, your use of Google Maps is governed entirely by Google's own terms and privacy policy, not by RPlan.

6.3 Other Third Parties. The Service may link to or integrate with other third-party websites, APIs, or services (see the Acknowledgments page for a full list of software used). We do not control and are not responsible for the content, policies, or practices of any third party.

7. Intellectual Property

The Service, including its design, code, branding, and content (excluding User Content and third-party content such as Google Maps data), is owned by RPlan or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent, except as permitted by applicable open-source licenses (if any apply to RPlan's codebase).

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • ANY TRIP PLANNING DATA, MAP DATA, ROUTES, DISTANCES, TRAVEL TIMES, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE (INCLUDING VIA GOOGLE MAPS) WILL BE ACCURATE, COMPLETE, OR CURRENT;
  • ANY DATA YOU SUBMIT WILL BE SECURE, PRESERVED, OR NOT SUBJECT TO UNAUTHORIZED ACCESS, LOSS, OR DISCLOSURE.

YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY TRAVEL INFORMATION, DIRECTIONS, OR PLANS BEFORE RELYING ON THEM, including through independent, authoritative sources, especially where safety, cost, timing, or legal travel requirements are involved.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL RPLAN, ITS OPERATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR TRAVEL-RELATED LOSSES (INCLUDING MISSED FLIGHTS, BOOKINGS, OR RESERVATIONS), ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO USE THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICH, AS THE SERVICE IS PROVIDED FREE OF CHARGE, IS ZERO EUROS (€0).

Some jurisdictions, including certain EU member states, do not allow the exclusion or limitation of liability for death, personal injury, gross negligence, willful misconduct, or fraud. Nothing in these Terms limits or excludes our liability where such limitation or exclusion is not permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless RPlan and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) your User Content.

11. Termination

We may suspend or terminate your access to the Service at any time, without notice or liability, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination (including Sections 5.2, 8, 9, 10, and 13) will survive.

12. Changes to the Service and These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the "Last Updated" date above, and where practical, we may provide additional notice (e.g., a banner on the site). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of France, except where mandatory consumer protection law grants you the right to bring proceedings in the courts of your own country of residence (which applies to consumers residing in the EU/EEA and cannot be waived by these Terms).

RPlan is available worldwide with no geographic access restrictions. If you access the Service from outside France, you remain responsible for compliance with local laws applicable to you, to the extent they apply alongside French law.

14. Miscellaneous

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and RPlan regarding the Service.
  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
  • No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
